View Full Version : Getting out of a Speeding ticket?

Ok it's been awhile since I've gotten a speeding ticket, well I can't say that anymore. I got a ticket in New Orleans today! Yes I was probably going over 25mph, but I wasn't going 38 mph like the police man said. Anyway, I asked to see the radar, but he said he couldn't show it to me. I didn't ask why and politely took my ticket. Does anyone know how to get out of this with out it going on my record. My insurance is high enough I don't want to add this on it.

When i got a ticket in N.O. all i did was go to court and asked if I could file article 894, this keeps the ticket off of your record but puts you on probation for 6 months, if you receive another ticket in that 6 months then they both go on your record. Anyway, what they did is actually dropped the ticket to a non-moving violation so it doesnt effect your insurance anyway. Someone please correct me if I have made a mistake in my explanation of article 894. But I hope this helps.

If nothing else though, like Babyboy said ask for an art. 894. Just gotta pay the fine, but gets expunged after 6 mos like he said.

I wouldn't waste my 894 on a speeding ticket. Call the DA and see if you can get it reduced to a non-moving and pay that. BTW, seatbelt tickets are a MOVING violation now!

They ended up changing my ticket to a non-moving violation in the end, i think its because the Art. 894 is "too" much paperwork!!!!

thanks for the info. Someone suggested writing a letter or contacting the officer. Anyone heard of doing that?

I would be VERY careful with that, call me paranoid. But it seems like if the officer was a caniving (excuse the spelling) p--ck, he could always say you were trying to bribe him. And with a letter or phone record could prove that you contacted him. Now I know the chances are slim, but these days you just never know.

Don't know how well it works, but everybody at work insists that if you mail them a money order for a couple dollars more than the cost of the ticket, it screws up their paperwork and they can't close it out so the money goes into the general fund and they get rid of the ticket. I tried it for the few tickets I've gotten down here and so far no bump in insurance $$.
I have no idea if it's just coincidence, though.

Tiff trust me dont try to write a letter... go to court and if your driving record is clear ask the DA for an 894... AFAIK NO's court systems are still not linked to the rest of the states and so the rest of the state doesn't know that you've gotten an 894 in NO and so it wont use yours up (you get one 894 every 5 years I believe it is)... then all you have to do is not get another violation in NO...

Haha! I've had several, maybe even 5. I believe you can't more than one at a time per parish. I know for sure I had one in Terrebonne, one in Lafourche and one in Jefferson all at the same time.
Back in December I got a speeding ticket, 80 in a 60, on I-10East near West-End blvd. I went to the courthouse, which is currently on the West bank near the ferry, and spoke with the DA. He instantly said he would drop it to 70 in a 60. Standard offer since there is 30+ people there waiting for the same thing. I then asked if there was a way I could keep it off my record for insurance reasons. He offer to move it to two non-moving tickets (no inspection and broken tailight) $300+ .
I went back the next day and spoke with the older white lady with blonde hair, I believe her name was Evelyn, and explained that I don't want it on my record b/c of insurance but can't afford $300+ b/c I'm a full-time student. She told me to come back in a month once she had the hard ticket (actual one) from the officer.
When I went back she changed it to 70 in a 60 and converted it to one non-moving, broken tail light. $117 dollars later with nothing to go to my insurance I was some happy!
I returned in a week with a thank you card and a gift card to Olive Garden for her.
What part of NO were you in? Anywhere in Orleans parish and you will have to go to the same place as I had gone.

I just checked its every 5 years for traffic and misdemeanors and every 10 years for a DWI...

I too have had an 894 in two different parishes at the same time. Terrebonne and Lafourche

some parishes/municipalities are linked into the state system some aren't... I've had 894's in like 7 different parishes and some knew about the others some didn't

I've written myself out of 2 speeding tickets in 2 different podunk towns...
I just asked them if they would change them to nonmoving violations, and let me simply pay the fines... They wrote back that they would, and so far, my record reflects the same... one was to a sherrifs office in turkey creek, and the other was for a ticket from a state trooper given in another parish outside of ringold, la, if I remember correctly... Not sure about NO, but it may be worth a try...

By this you mean you actually wrote the department NOT the officer right? I could understand making this attempt, but to actually trying contact the officer, I wouldnt even attempt!

Correct, they were sent to the respective departments, not directly to the officers. On the turkey creek ticket, I called to get thier mailing info, and told the lady there, my plight, and she said that the chief would be able to make those changes. She then asked for the officer's name on the ticket, when I told her, she chuckled at the answer, and said he was the chief... but she said they would change it, no problem...
